Medi-Cal Recovery bill now a 2-year bill!

SB 33 (Hernandez) would limit Medi-Cal recovery for those who are 55+ years of age to only what is required by federal law, and eliminate optional recovery for other services; eliminate recovery on surviving spouses’ estates; allow hardship exemptions for homesteads of modest value; and limit the amount of interest the state can charge.Except for one no vote - from Rocky Chavez (R-Oceanside) in Assembly Health - SB 33 has passed unanimously out of every Committee and in the Senate. Clearly Democrats and Republicans alike see SB 33 as a positive step toward a fair and equitable recovery process and recognize that taking away the homes of the poor is no way to grow California. However, due to resistance by the Department of Health Care Services and Governor and his finance staff, SB 33 has been pulled and held until the 2016 session. We will keep you informed as to the status in 2016.
