Advocacy Resources on the New Federal Nursing Home Regulations


Consumer Voice, Justice in Aging and the Center for Medicare Advocacy have teamed up to publish advocacy materials and presentations on the new federal nursing home regulations. The resources include summaries of key changes, a side-by-side comparison of the revised & previous regulations, issue briefs, a webinar, and links to CMS memos on implementation of the regulations.

The new regulations, which were published on October 4, 2016, are being phased in over a three-year period. Phase-one changes took effect on November 28, 2016.

Unfortunately, the most important new requirement – a ban on pre-dispute arbitration agreements – has been stayed by a federal court order in Mississippi ruling on behalf of the American Health Care Association.

The American Health Care Association has announced that it is seeking repeal of the regulations under an obscure federal law, the Congressional Review Act, which gives Congress an opportunity to reverse regulations that were adopted late in a prior session of Congress.
