SB 1248 will guarantee equal rights for California nursing home residents by requiring all California nursing homes to comply with residents' rights established under federal law. Currently, residents of Medicare and Medi-Cal certified nursing homes have greater rights than residents of non-certified nursing homes. SB 1248 will remedy this inequity by extending the federal rights to all residents. The rights extended by SB 1248 are very basic, like the right to choose your doctor, to have reasonable needs accommodated and to notice before eviction.

The Legislature passed SB 1248 on August 22, 2006, and sent it to Governor Schwarzenegger for his signature. Please write the Governor and urge him to sign this bill.

Dear Governor Schwarzenegger:

I urge you to sign SB 1248 (Alquist), which will establish equal rights for all California nursing home residents.

Currently, many residents who are paying privately for their care lack rights that exist for people in Medicare or Medi-Cal certified nursing homes. There is no basis for nursing home residents having two sets of rights, especially in such matters as eviction and choice of a physician, based on source of payment.

SB 1248 will correct this inequity by requiring all California nursing homes to comply with residents' rights established under federal law. It will ensure all California nursing home residents have equal rights, no more, no less.

Please give all California nursing home residents equal rights by signing SB 1248. Thank you for your consideration.
