A. Long Term Care Medi-Cal: The Basics
This 2.5 hour MCLE special pre-conference session will include an overview of long term care; the Medi-Cal long term care application process; share of cost; treatment of income and assets; transfer of assets rules; spousal impoverishment issues, including court orders; options for treatment of the home; and Medi-Cal recovery issues. A must for those new to Medi-Cal and long term care estate planning issues.

B. EADACPA Clinic—Sharpening the Tools**
The Elder Abuse and Dependent Adult Civil Protection Act: the latest on Medi-Cal and Medicare liens, piercing the corporate veil, care-giver fraud, standing, pleading, and an open floor discussion on problem areas, issues, and concerns..

When Estate Planning and Elder Financial
Abuse Collide

A facilitated panel discussion on elder abuse
issues and estate planning resolutions:
avoiding pre-dispute arbitration agreements
in DPAs and advance directives; an analysis
of the We the People lawsuit by the litigator
and estate planner involved.

    Using a sample case, panelists will discuss viable planning techniques contrasting current and upcoming Medi-Cal eligibility rules, Medi-Cal pre-planning including defective grantor trusts, care contracts and other options to avoid impoverishment.

  2. Using Data in Elder Abuse & Resident
    Rights Cases

    Using PIVOT data, ASPEN, OSCAR and
    ownership data in litigating nursing home
    abuse cases: an in-depth look at verifying
    facility costs and staffing levels.

  1. VA Benefits: Focus on Aid and
    Attendance Benefits

    Using sample cases, the session will include a review of the basic eligibility for VA Aid and Attendance benefits, including how income is counted, treatment of assets, the pros and cons of trusts and annuities, integration with Medi-Cal in the community and in long term care and how to identify VA scams. The impact of the proposed federal law will also be discussed.

    Updates on new ACWDLs case law, state
    and federal legislation and regulations,
    including implementation of AB 641 and its
    impact on LGBT estate planning for long
    term care.

  2. Elder Abuse Updates: Case Talk
    Updates on financial abuse and neglect
    litigation cases, elder product liability,
    actions involving State entities and the
    impact of the recent Covenant Care
    decision.

    and Recovery

    Bring your questions about Medi-Cal
    eligibility, Recovery and planning strategies
    to this panel of experts for a facilitated
    session designed to answer the burning
    questions of the day. Robert Sugawara,
    Acting Division Chief, Medi-Cal Eligibility,
    Sharyl Shanen-Raya, Medi-Cal Eligibility,
    and Margaret Hoffeditz, Chief, Medi-Cal
    Recovery Unit, have confirmed.

  2. Point/Counterpoint: Plaintiff and
    Defense Perspectives

    This popular session will include a lively
    discussion of disparate views on a variety
    of cutting edge topics from plaintiff and
    defense attorneys. Attendees are invited
    to submit questions before and during the
    session.

B. Injunctive Relief: A Tool for Quality Care
An interactive discussion using case
hypotheticals exploring the value of
Section 1430(b) in gaining injunctive
relief and systemic change for current
and future residents.

    A facilitated panel discussion geared toward answering frequently asked questions about trusts, such as how to address disputes about trusts, special needs trusts, the current status of pooled trusts and Medi-Cal, impact of Lewis v.
