POLSTs, 12:00 - 1:00 pm
This webinar will focus on all things POLST. We will review the legislative history of the POLST and the statutes that govern its use. We will closely examine the POLST form that is now being used statewide. Then, we will turn our attention to the POLST in practice, focusing on the proper role of the form among the other forms of advance health care planning and how POLSTs have been implemented in various health care settings. Particular attention will be paid to some of the perceived problems with POLST and its governing statutes.

Conservatorships in California, 12:00 - 1:00 pm
This webinar is designed for advocates interested in helping proposed conservatees fight their conservatorship but should be of interest to anyone who advises clients regarding probate conservatorship issues. We will discuss the ethics of representing persons with allegedly impaired capacity as well as how to oppose or limit conservatorships. We will also review the highlights of CANHR’s groundbreaking statewide conservatorship study, which analyzes the factors that affect conservatorship outcomes and makes subsequent policy recommendations. This webinar will include ½ hour of Ethics MCLE.

No Capacity, No Family, Now What?, 12:00 - 1:00 pm
What do attorneys do when they have a potential client with questionable capacity and no representative? California laws address legal capacity and decision making in a piecemeal fashion. As a result, decision making for people who lack capacity and a legal representative is erratic and often illegal. This webinar will review the merits of various options for assisting clients with no capacity and no representative, focusing primarily on the determination of capacity and financial and health care decision-making. We will also carefully examine social and government resources that may be available to help. Finally, we will assess an attorney’s ethical obligations in representing clients with questionable capacity. This webinar will include ½ hour of Ethics MCLE.

Imprisoned in an RCFE: Tales from a Locked-Door Dementia Unit, 12:00 - 1:00 pm
Many large assisted living facilities include locked-door units designed to keep the residents from leaving. We will assess the laws governing locked-door placements for elderly or disabled residents and discuss the application of these laws to the current realities of locked-door units. The goal of this webinar is to enhance the advice given to family members who are considering placing a loved one in a locked-door unit as well as to strengthen the advocacy when representing a resident of such a unit.
