CANHR’s Legislative Wins Improve Long Term Care Resident Rights

Governor Newsom signed into law three important pieces of legislation sponsored by CANHR this month. AB 48, the Nursing Facility Resident Informed Consent Protection Act of 2023, by Asm. Aguiar-Curry, formalizes the psychotropic drug discussion between prescribers and residents and empowers residents and their decision makers to stop inappropriate drugging. AB 1309, by Asm. Gómez Reyes, requires nursing homes to share discharge plans and other key documents with residents they propose to discharge, allowing residents to better assess the safety of a proposed discharge and improve their chances of winning an administrative appeal if they pursue one. AB 979 by Assemblymember David Alvarez modernizes existing family council laws in both nursing homes and residential care facilities for the elderly (RCFEs).
