Assisted living giant Brookdale has been sued in federal court for promising services that it does not deliver. The case alleges that Brookdale systemically provides insufficient staffing based on “predetermined labor budgets and desired profit margins” instead of the actual care needs of the residents. As a result, residents throughout Brookdale’s 89 assisted living facilities in California suffered various injuries and indignities. The lawsuit is believed to be the first class action brought against an assisted living provider under the Americans with Disabilities Act.
