| San Jose, CA – Sava Senior Care has been sued in Santa Clara County Superior Court for dumping residents to motels or other highly unsafe and inappropriate places. The centerpiece of the lawsuit is allegations that all six California nursing homes in the Sava chain routinely refuse to provide residents with an advance written notice of their discharge and their rights to contest the discharge, despite a 31-year-old law requiring such a notice. The failure to give written notice is just one of many systemic regulatory violations perpetrated by nursing homes to turn out low-paying residents in favor of highly reimbursed short-term Medicare residents. While plenty of laws exist to prevent such inappropriate discharges, the state Department of Public Health ineffectively enforces them. “Billions of taxpayer dollars go to California nursing homes to care for elderly and disabled residents” said CANHR Staff Attorney Tony Chicotel. “They get paid to care for residents but they often don’t care about residents and what happens to them after they are forced to leave the facility.” The lawsuit was filed by BraunHagey & Borden LLP. |
