OIG Finds Rampant Violations of Nursing Home Discharge Rules

The federal Health and Human Services’ Office of the Inspector General (OIG) released a report analyzing nursing home resident evictions and found that the vast majority were illegal.  Of the 126 evictions that were evaluated, the facilities either failed to give the required written notice or gave incomplete notice in a staggering 101 (80%) of them.  Facilities also failed en masse to provide legally required documentation to support resident evictions.  A second OIG report found that dumping residents into hospitals is common (37% of the evictions) while 8% of the residents were sent to motels or “unknown” or “nonspecific” locations.  The information about the evictions was self-reported by nursing homes, so the cases are not a representative sample – meaning the average eviction is likely even more problematic than those in the reports.
